Nongshim Cook & Win Giveaway

1. Introduction

Nongshim Cook & Win Contest (the “Contest”) is organised by GBA Corporation Sdn. Bhd. (Company No. 162820-U) (the “Organiser”) whose registered office is at Wisma GBA 2, Lot 8, Jalan PPU 3, Taman Perindustrian Puchong Utama, 47100 Puchong, Selangor, Malaysia.

1.1 These rules apply to Nongshim’s Cook & Win contest that is promoted on and run through Nongshim’s official website or social media channels.

1.2 To enter a competition, the participant must enter as directed on our social media channels.

1.3 The Contest is open to all Malaysian citizens aged 18 and above, residing in Malaysia only (each a “Participant” and collectively, the “Participants”).

2. Eligibility and entry restrictions

2.1 To be eligible to enter a competition:

Participants must be a real person, at least 18 years old and permanently reside in Malaysia (proof of address or age may be required)
Participants for our promotions and contests on social media must have a genuine account.

The following group of persons shall not be eligible to participate in the Contest:

Employees of the Organiser [including its affiliated and related companies] and their immediate family members [children, parents, brothers and sisters, including spouses]; and/or
Representatives, employees, and/or agents of advertising and/or contest service providers of the Organiser [including its affiliated and related companies], and their immediate family members [children, parents, brothers and sisters, including spouses].

2.2 Entry via Instagram/ Facebook posting

Participants must take a picture of their own unique dish made with Nongshim Shin Stir Fry, with a Nongshim Shin Stir Fry pack featured in the picture.
Complete the caption: “I love Nongshim Shin Stir Fry because…”& @NongshimMalaysia (FB) or @nongshim_malaysia (IG), and hashtag #nongshimmalaysia and #myshinstirfry.
Upload your photo to Facebook or Instagram and set the post as ‘public’.
3 winners will be selected weekly, over a 5-week contest period (Total 15 winners)

2.3 Multiple entries are permitted but each eligible Participant will only be entitled to win one (1) weekly prize throughout the Contest Period.

2.4 The Organiser reserves the right to reject and/or remove any entries that are incorrect, incomplete, suspicious, invalid or do not meet the Contest Terms and Conditions. Participants agree not to knowingly damage or cause interruption to the Contest and/or prevent others from entering the Contest.

2.5 The Organiser reserves the right to reject and/or remove any entries that are deemed inappropriate and/or offensive to others. Participants agree not to submit entries that promote or portray nudity, sexually explicit material, coarse or offensive language, or other material susceptible of offending others.

3. Judging

3.1 Competition entries shall be judged based on the following criteria:

Presentation & innovation of the dish – 50%
Creative caption – 20%
Visibility of Nongshim Shin Stir Fry pack – 10%
Tagged relevant hashtags and correct official Nongshim Malaysia account – 20%

3.2 If a competition entrant does not meet the eligibility requirements or is subject to any entry restrictions, that entrant shall not be entitled to be adjudged a winner, and will not be entitled to a prize in any circumstances.

3.3 Our decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.

4. Prizes

4.1 The winning prizes are listed out as below:

One (1) Limited Edition Nongshim Shin Stir Fry Pillow worth RM50. (15 units)

4.2 Weekly Winners

There will be a total of 15 weekly winners eligible to win a Limited Edition Nongshim Shin Stir Fry Pillow throughout the contest period with the following winner breakdown

4.2.1 Weekly winners can only win the weekly prize (Limited Edition Nongshim Shin Stir Fry Pillow) once (1) per winner throughout the contest period.

4.3 The organiser reserves all rights to change prizes in any case lf stock limitations or model changes of similar value.

4.4 The Organizer will courier out the prize within twenty-eight [28] days from the date of receiving full contact details from the winner.

5. Start and closing dates

The contest officially commences on 00:00:00 on 21st November 2022 until 23:59:59 on 25th December 2022.

5.1 Below is the timeline for the participation/ submission of entries for the contest:

Week 1: 21st November 2022 – 27th November 2022

Week 2: 28th November 2022 – 4th December 2022

Week 3: 5th December 2022 – 11th December 2022

Week 4: 12th December 2022 – 18th December 2022

Week 5: 19th December 2022 – 25th December 2022

5.2 Any entries received before the opening or after the closing of the competition will be invalid and will not be entered into the competition.

5.3 We reserve the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of our control. Any changes to the competition will be notified to entrants as soon as possible by us.

5.4 Entry into the competition will be deemed as acceptance of all of these terms and conditions.

6. Winner selections

6.1 Each winner selected can only be entitled to one (1) weekly prize as stipulated by the organizer throughout the contest period.

6.2 Winners will be contacted via e-mail or Direct Message on Instagram/ Facebook.

6.3 The organizer will not be held responsible if the winner selected could not be contacted for any reason.

6.4 The organizer holds the right to disqualify any winner who does not reply within the stipulated number of attempts to contact the winner (3 attempts), in this case, another entry will be selected as the new winner.

6.5 If the winner cannot be contacted, the registration is ineligible, or the winner fails to claim the Prize, the Prize may be forfeited and an alternate winner may be selected. Refusal or return of the winners’ notification as undelivered will also result in disqualification and an alternate winner may be selected.

7. Privacy

7.1 By participating in this Contest, the participants give consent and absolute right to the Organiser to use their names, photographs and their prizes as materials for the purposes of advertising, marketing, trade and/or publicity, without any prior notice. The participants shall not be entitled to claim ownership and/or other forms of compensation for the use of the materials by the Organisers.

7.2 The winner(s) therefore agrees to the use of their name, photograph in any post-prize-winning publicity and prize details upon entry of this contest.

8. Liability & Responsibility

8.1 Participants shall assume full liability and responsibility in case of any liability, mishap, injury, damage, claim or accidents [including death] resulting from their participation in the Contest, redemption and/or utilization of the prize and agree to irrevocably and unconditionally release and hold the Organiser free and harmless of any liability for any reason whatsoever.

8.2 The Organiser and its respective parent companies, affiliates, subsidiaries, licensees, directors, officers, agents, independent contractors, advertising, promotion, and fulfilment agencies, and legal advisors are not responsible for and shall not be liable for:

Any technical errors, whether due to inaccessibility of internet, network disruptions, network congestion, malicious virus attacks, unauthorised data hacking, data corruption and server hardware failure or otherwise;
Telephone, electronic, hardware or software programme, network, internet, server or computer malfunctions, failures, interruptions, miscommunications or difficulties of any kind, whether human, mechanical or electrical, including without limitation, the incorrect or inaccurate capture of entry information online;
Late, lost, delayed, misdirected, incomplete, illegible or unintelligible uploads;
Failed, incomplete, lost, garbled, jumbled, interrupted, unavailable or delayed computer transmissions;
Any condition caused by events beyond the control of the Organiser that may cause the Contest to be disrupted or corrupted;
Any injuries, losses, or damages of any kind arising in connection with or as a result of the gift, or acceptance, possession, or use of the Prize, or from participation in the Contest;
Any printing or typographical errors in any materials associated with the Contest.

9. Rights of the Organiser

9.1 The Organiser reserves the right to revise the mechanics of the Contest, the Terms and Conditions, and other aspects of the Contest at its discretion without prior notice.

9.2 The Organiser reserves the right, in its sole discretion, to disqualify any participant that is found or suspected of tampering with the Contest submission process or the operation of the Contest and the Organiser reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to the Contest.

9.3 The Organiser reserves the right to suspend, cancel or extend the duration of the Contest at its discretion due to unforeseen circumstances without prior notice.

9.4 In case of any dispute, the Organiser reserves the right to make the final decision.
